Institutional Imbalances, Type of Regime and Prospects of Public Policy under Democratic Federalism in Pakistan

In contemporary federal literature, federalism is viewed as a political system established on democratic rules, practices and institutions. This leads to the sharing of powers between central and provincial governments with a conflict resolution approach especially in multi-linguistic and ethnically diverse states. The constitution of a federal state institutes the structure and intents of federal political system however it is the type of regime, ruling a state which primarily manifests the politics of federalism and mechanism for public policy. The study predominantly pronounces that due to repeated political shocks and breakdown, an acute centralization of political power and authoritarianism persisted in Pakistan which largely led to provincial autonomy and federal notion under a persistent stress. Owing to intervals of military led politics, federal and political institutions remained less successful to devise viable public policy framework and federal solutions in response to the conflicts stemming out of ethnic and regional discrepancies in Pakistan. The research explicates that institutional imbalance during the civilian decade of 1988-1999 and extended role of military in politics from 1999-2008 augmented the federal challenges in Pakistan.

The challenges of federalism in Pakistan are multidimensional in nature and largely associated with various dynamics of politics. Lack of democratic practices, political instability, low political culture and type of government exercising its control at the federal level are those factors which considerably affect the federal politics in Pakistan. The repeated dissolutions of the National Assembly and the consequent fall of provincial assemblies during the decade of the1990s also stressed the federal notion in Pakistan. The problems of federalism in Pakistan were further augmented by the arrival of a military administration in power on October 12, 1999.Even though, a constitutional government was established as a result of the general election of 2002but it did not diminish the centralization and authoritarian trends as the center of political power was still a military man. This paper expounds that under Musharraf regime, prime intent of devising policies was to secure legitimacy of his rule and federal issues were not dealt with federal and political means. This research expounds that type of regime is relevant to federal practices in Pakistan and military led regimes in Pakistan are less responsive to federal challenges and ethnic demands as under their conception of unity in command, federal consensus and bargain are less pertinent. This led to decline the role of elected legislatures and federal institutions as the federal notion of the state was largely hampered. This study aims to address the issue that how military intervention into politics augmented the federal problems in Pakistan and to what extent type of regime is relevant to federal practices in Pakistan?

This work provides a twofold nature in relation to the law of Pakistan: firstly, constitutionalism being a broad public law concept applies to an analysis of the ongoing development and gradual maturing of this phenomenon in Pakistan. This endeavor helps place the thesis into a rich field of legal and law related literature that examines the trajectories of post-colonial countries in terms of their constitutional struggle and related developments. It provides a more descriptive framework that is useful in its own right as an orderly exposition of largely existing knowledge, ideally with updates on recent significant developments that major scholarly contributions from the earlier times did not yet included. If the effects of institutional reforms are long-term and unpredictable, why do leaders undertake them? We analyze reforms where the incentives of agents pursuing a change, and the effects of that change, are highly asymmetric in time and policy dimensions. We examine detailed evidence from decentralization in Bolivia and Pakistan, and explain very different outcomes with a simple game-theoretic model of the incentives and interactions amongst ruling and opposition parties, and civil society, over multiple periods. Politicians decentralize to solve a discrete, often short-term political problem. But decentralization is neither short-term nor discrete, but rather a deep change in the structure of public finance and authority with long-term effects on government, politics and society. Amongst other things, this work presents a periodized study of Public Interest Litigation (PIL) in Pakistan based on an extensive qualitative and quantitative review of all 218 reported judgments of the Supreme Court in its original jurisdiction over a 25-year period (1988 to 2013). The qualitative analysis aims to provide a wide range of metrics for gauging shifts in PIL jurisprudence, the nexus of these shifts with judicial strategy, and the overall trends in judicial activism—and retreat—over time. The quantitative analysis is juxtaposed with the qualitative analysis to: (1) chart changes in the frequency and proportion of unconstitutional rulings (broadly defined as rulings that declare executive action or legislation unconstitutional); (2) observe the differential make up of litigants; and (3) examine the evolution of types of issues adjudicated over time. On the basis of a combined evaluation of the qualitative and quantitative data, the study identifies and divides PIL into three “waves” of judicial activism punctuated by two “troughs” signifying judicial retreat. These waves and troughs are further sub-divided into distinct phases that represent milestones within each wave or trough. The periodized study also introduces into the PIL discourse new analytical categories for identifying and enumerating different types of PIL cases as well as for gauging the relative importance and currency of each type of PIL over time. These categories include: Typical PIL, Political PIL, Class Action PIL, and High Court Writ PIL. A central conclusion of the PIL study is that despite the many changes that PIL has undergone in the quarter-century of its existence, it continues to evolve on a continuum that is remarkably unchanging in terms of the structural relationship between the judiciary and civilian-democratic politics. This is because of cyclical military interventions that have stunted, even hijacked, democratic transition and, in the process, used the constitutional courts for the twin purposes of legitimation of de facto government and de-legitimation of civilian politics. At the same time, the unique status of the Supreme Court as an intermediary between authoritarian and elected governments allows it to assert its autonomy and ascendancy over the political sphere in periods of civilian rule – and more recently against military-civilian partnerships that derive their formal legitimacy through international aid and rule of law rhetoric. The Supreme Court‘s assertion of autonomy grows out of its need for self-legitimation at the beginning of every cycle of democratic transition. The main casualty of this deeply institutionalized practice of “judicial self-legitimation” is the democratic process.

This chapter theorizes founding moments in constitutionalism in the context of Pakistan and advances the argument that the creation of the ‘Permanent ’ Constitution of 1973 is central to Pakistan’s constitutional identity.
